SSDI (Social Security Disability Insurance) is based on your work history and the Social Security taxes you've paid. SSI (Supplemental Security Income) is a needs-based program for disabled individuals with limited income and resources, regardless of work history. You may qualify for both programs simultaneously.
Initial applications typically take 3–6 months for a decision. If denied and you appeal, the process can take 1–3 years to reach an ALJ hearing. Having an experienced attorney significantly improves your chances of approval and can help expedite the process in some circumstances.
Don't give up — most initial claims are denied. You have 60 days from the date of your denial letter to file an appeal. Contact our office immediately. We will review your denial, identify the reasons for it, and build a stronger case for your appeal. The sooner you act, the better.
There is no upfront cost. We work on a contingency fee basis, which means we only get paid if you win. The fee is regulated by federal law and is typically 25% of your back pay award, capped at $7,200. If you don't win, you owe us nothing.
The SSA maintains a "Blue Book" listing of qualifying conditions, including musculoskeletal disorders (back problems, arthritis), cardiovascular conditions, mental health disorders (depression, PTSD, anxiety), neurological conditions (MS, epilepsy), cancer, diabetes complications, and many more. Even if your condition isn't listed, you may still qualify if it prevents you from working.
